O presente artigo se propõe a examinar criticamente o atual e dominante paradigma político, que aqui definiremos como terrorismo legal de Estado. Para tanto, fez-se necessário o recurso a três autores cujas reflexões buscam compreender a sua natureza e os seus principais modos de atuação, a saber, o filósofo italiano Giorgio Agambem, o jurista argentino Raúl Zaffaroni e o sociólogo francês Loic Wacquant. A partir das obras agambenianas Homo Sacer. O poder soberano e a vida nua I e Estado de (...) Exceção, elucidaremos o conceito de estado de exceção e o processo que, ao transformá-lo em prática permanente, marcou o ingresso definitivo do Estado na lógica do terrorismo. A materialização deste exercício de poder se dá – sobretudo nas conjunturas do continente americano, a referência empírica da pesquisa aqui apresentada – principalmente por meio da eliminação pelo encarceramento, levada a cabo por um direito penal punitivista que será compreendido à luz das obras O inimigo no direito penal (Zaffaroni) e Crime e castigo nos Estados Unidos: de Nixon a Clinton (Wacquant). Glucagon-like peptide-1 (GLP-1) receptor agonists, such as semaglutide, and dual GLP-1 and glucose-dependent insulinotropic polypeptide (GIP) receptor agonists, such as tirzepatide, have been found to be effective for treating obesity and diabetes, significantly reducing weight and the risk or predicted risk of adverse cardiovascular events. There is a global shortage of these medications that could last several years and raises questions about how limited supplies should be allocated. We propose a fair-allocation framework that enables evaluation of the ethics of current (...) practices and could guide governments, professional societies, and physicians in allocation decisions. Four ethical values — maximizing benefits, treating equally, promoting and rewarding instrumental value, and giving priority to the worst off — yield six specific recommendations for allocating medical resources in the Covid-19 pandemic: maximize benefits; prioritize health workers; do not allocate on a first-come, first-served basis; be responsive to evidence; recognize research participation; and apply the same principles to all Covid-19 and non–Covid-19 patients.

The distinction between lying and mere misleading is commonly tied to the distinction between saying and conversationally implicating. Many definitions of lying are based on the idea that liars say something they believe to be false, while misleaders put forward a believed-false conversational implicature. The aim of this paper is to motivate, spell out, and defend an alternative approach, on which lying and misleading differ in terms of commitment: liars, but not misleaders, commit themselves to something they believe to be (...) false. This approach entails that lying and misleading involve speech-acts of different force. While lying requires the committal speech-act of asserting, misleading involves the non-committal speech-act of suggesting. The approach leads to a broader definition of lying that can account for lies that are told while speaking non-literally or with the help of presuppositions, and it allows for a parallel definition of misleading, which so far is lacking in the debate. It is widely held that all lies are assertions: the traditional definition of lying entails that, in order to lie, speakers have to assert something they believe to be false. It is also widely held that assertion contrasts with presupposition and, in particular, that one cannot assert something by presupposing it. Together, these views imply that speakers cannot lie with presuppositions—a view that Andreas Stokke has recently explicitly defended. The aim of this paper is to argue that speakers can lie (...) with presuppositions, and to discuss some of the implications this outcome has for current research on lying, assertion and presupposition. Certifications of immunity are sometimes called “immunity passports” but are better conceptualized as immunity-based licenses. Such policies raise important questions about fairness, stigma, and counterproductive incentives but could also further individual freedom and improve public health. Immunity licenses should not be evaluated against a baseline of normalcy, ie, uninfected free movement. Rather, they should be compared to the alternatives of enforcing strict public health restrictions for many months or permitting activities that could spread infection, both of which exacerbate inequalities and (...) impose serious burdens. Sometimes speakers try to lie and inadvertently assert something true. Subjectivists about lying hold that such speakers are lying despite telling the truth. Objectivists hold that such speakers are not lying: they try to lie but fail. The first aim of this paper is to point to novel cases supporting subjectivism that do not involve speakers inadvertently asserting something true. Its second aim is to use these and other cases to explore the distinction between lying and trying to lie. Which (...) factors can thwart an attempt at lying? In which situations do we judge that a speaker has tried to lie but failed? Attending to these questions not only offers insights into the act of lying, but also helps to scrutinise the objectivist strategy of explaining away intuitions about apparent cases of lying while telling the truth. In this article, we propose the Fair Priority Model for COVID-19 vaccine distribution, and emphasize three fundamental values we believe should be considered when distributing a COVID-19 vaccine among countries: Benefiting people and limiting harm, prioritizing the disadvantaged, and equal moral concern for all individuals. The Priority Model addresses these values by focusing on mitigating three types of harms caused by COVID-19: death and permanent organ damage, indirect health consequences, such as health care system strain and stress, as well as (...) economic destruction. It proposes proceeding in three phases: the first addresses premature death, the second long-term health issues and economic harms, and the third aims to contain viral transmission fully and restore pre-pandemic activity. -/- To those who may deem an ethical framework irrelevant because of the belief that many countries will pursue "vaccine nationalism," we argue such a framework still has broad relevance. Reasonable national partiality would permit countries to focus on vaccine distribution within their borders up until the rate of transmission is below 1, at which point there would not be sufficient vaccine-preventable harm to justify retaining a vaccine. When a government reaches the limit of national partiality, it should release vaccines for other countries. -/- We also argue against two other recent proposals. Distributing a vaccine proportional to a country's population mistakenly assumes that equality requires treating differently situated countries identically. Prioritizing countries according to the number of front-line health care workers, the proportion of the population over 65, and the number of people with comorbidities within each country may exacerbate disadvantage and end up giving the vaccine in large part to wealthy nations. BackgroundIn recent years, there have been many studies using the Affective Neuroscience Personality Scales (ANPS) to investigate individual differences in primary emotion traits. However, in contrast to other primary emotion traits proposed by Jaak Panksepp and colleagues, there is a considerable lack of research on the LUST (L) dimension – defined as an individual’s capacity to attain sexual desire and satisfaction – a circumstance mainly caused by its exclusion from the ANPS. Therefore, this study aims to take a first step (...) toward the development of a standardized self-rate measurement for the L-disposition. For this purpose, two versions of the L-scales (L-12 and L-5) were developed and evaluated regarding reliability and aspects of validity.Materials and MethodsAfter a pilot study (N= 204; female: 81%) with an initial 20-item pool item reductions were conducted. This led to the construction of a 12-item (L-12) version and a 5-item version (L-5), which were assessed in a second sample consisting of 371 German-speaking healthy adults (58.50% female) aged 18–69 years (M= 28;SD= 9.75). Aspects of external validity were assessed by investigation of correlations with the ANPS, psychiatric symptoms (Brief Symptom Inventory-18), attachment security (Adult Attachment Scales) and personality functioning (Operationalized Psychodynamic Diagnostics Structure Questionnaire). To evaluate structural validity, both L-scales were investigated via confirmatory factor analysis (CFA).ResultsCronbach’s α indicated excellent internal consistency regarding L-12 (α = 0.90), while L-5 showed acceptable reliability (α = 0.82). CFA of a bifactor model of the L-12 indicated excellent model fit. Moreover, an excellent model fit was observed regarding a single factor model of L-5. For both scales small to moderate positive correlations were observed with SEEKING, PLAY, and secure attachment, while they exhibited small to moderate negative correlations with SADNESS, insecure attachment, lower personality functioning, and increased psychiatric symptom load.ConclusionBoth newly developed scales exhibit satisfying psychometric properties, indicating high reliability, good structural validity and plausible correlations with external criteria. Hence, this study poses an important step toward the operationalization of the LUST concept. However, more research is needed in particular with respect to the scale’s external validity and its applicability in clinical populations. (shrink)

This paper is concerned with fictive utterances, the authorial utterances that make up works of fiction. It is widely held that fictive utterances cannot be constative speech acts, such as assertions. Instead, fictive utterances are construed as pretended speech acts, as invitations to make-believe or as declarations. My aim is to challenge the non-constative consensus and to defend a view on which fictive utterances are constative speech acts after all, namely constatives that have a story as their target. I motivate (...) the constative view by discussing works of fiction that feature plot twists. Some of these plot twists indicate that fictive utterances can carry assertoric commitment and can be lies, contrary to what is commonly assumed. And I spell out a version of the constative view that takes cues from Stalnaker’s common ground account of assertion and the debate on commitment and responsibility in constatives. (shrink)

In arguing against a supposed ambiguity, philosophers often rely on the zeugma test. In an application of the zeugma test, a supposedly ambiguous expression is placed in a sentence in which several of its supposed meanings are forced together. If the resulting sentence sounds zeugmatic, that is taken as evidence for ambiguity; if it does not sound zeugmatic, that is taken as evidence against ambiguity. The aim of this article is to show that arguments based on the second direction of (...) the test are misguided: ambiguous expressions, and in particular philosophically contested ones, do not reliably lead to zeugmaticity, so an absence of zeugmaticity provides no meaningful evidence for an absence of ambiguity. In this article, I present a new argument for God’s existence, which I term the argument from non-bruteness. The argument is premised on the idea that the fundamental structure of reality cannot be a brute fact and must have an ultimate reason. By focusing on the concept of self-evidence, I first examine the relationship between possible worlds and what I refer to as cognitive perspectives. I then argue that an ultimate explanation for reality's fundamental structure necessitates an absolute perspective—one that (...) fully grasps this explanation— thereby affirming the existence of God as the absolute subject who possesses it. Intentionalism is the view that demonstratives, gradable adjectives, quantifiers, modals and other context‐sensitive expressions are intention‐sensitive: their semantic value on a given use is fixed by speaker intentions. The first aim of this paper is to defend Intentionalism against three recent objections, according to which speakers at least sometimes do not have suitable intentions when using supposedly intention‐sensitive expressions. Pictures are notably absent from the current debate about how to define lying. Theorists in this debate tend to focus on linguistic means of communication and do not consider the possibility of lying with photographs, drawings and other kinds of pictures. The aim of this paper is to show that such a narrow focus is misguided: there is a strong case to be made for the possibility of lying with pictures and this possibility allows for insights concerning the question of (...) how lying should be defined. I propose a new argument for the existence of God. God is defined as a conscious being that is the first cause of reality. In its simplified initial form, the argument has two premises: all possible truths are knowable, and it is impossible to know that the proposition that God does not exist is true. From and it follows that the proposition that God exists is necessarily true. After introducing the argument in its crude initial form and laying out the (...) core intuitions behind its premises, I point to two difficulties that this simplified version faces. I then go on to show how the argument can be revised to handle these difficulties. I defend the revised argument from various objections. (shrink)

Lying requires asserting a disbelieved proposition, that much is widely accepted in the debate on how to define lying. But what else is required? Does lying require a particular linguistic manner of expression, such as saying? Does the proposition asserted have to be false (and not merely disbelieved)? And does lying require an intention to deceive? In a recent paper, Stefan Wintein criticizes my responses to the objections he raised to my modal-epistemic argument (MEA) for the existence of God. In this paper, I continue our debate and respond to Wintein’s criticisms of my previous responses. I argue that Wintein’s criticisms are unsuccessful. As a result, the MEA still stands.

In this article, we explore whether cross-linguistic differences in grammatical aspect encoding may give rise to differences in memory and cognition. We compared native speakers of two languages that encode aspect differently (English and Swedish) in four tasks that examined verbal descriptions of stimuli, online triads matching, and memory-based triads matching with and without verbal interference. Results showed between-group differences in verbal descriptions and in memory-based triads matching. However, no differences were found in online triads matching and in memory-based triads (...) matching with verbal interference. These findings need to be interpreted in the context of the overall pattern of performance, which indicated that both groups based their similarity judgments on common perceptual characteristics of motion events. These results show for the first time a cross-linguistic difference in memory as a function of differences in grammatical aspect encoding, but they also contribute to the emerging view that language fine tunes rather than shapes perceptual processes that are likely to be universal and unchanging. Could our concept of art, in its deepest sense, be responsible for democracy? Or, could our concept of democracy exist because of art? This paper is a reflection on these questions. Normally, a scientific text should give answers but would this principle be universal? Inside our planetary metamorphosis all values (...) are changing as always but now at high speed. High speed gives us both the sensation of confusion, which was typical in other historical moments, as when Carmina Burana was elaborated in the Middle Ages, and the possibility to take a step back and have, in the eye of the cyclone, dynamic elements showing us change in process. Welfare capitalism is going through a deep crisis, and alternative models to welfare state capitalism such as liberal socialism and property-owning democracy are once again becoming prominent in public debates. The aim in this article is to compare the merits and the limits of liberal socialism and of property-owning democracy through the specific case of the distribution of educational capital, by comparing two educational systems: the Pay It Forward (PIF) system and the Tax-subsidy scheme (TS) system. Based on the analysis (...) of these two educational systems, we provide three arguments in favor of liberal socialist institutions in general and the PIF educational system in particular: (1) the individual common assets argument, (2) the principle of reciprocity argument, and (3) the predistribution argument. This book was inspired originally by the debates at the turn of the century about placebo controlled trials of antiretrovirals in HIV positive pregnant women in developing countries. Moving forward from this one limited example, the book includes several additional controversial cases of clinical research conducted in developing countries, and asks probing philosophical questions about the ethics of such trials. All clinical research by its very nature uses people to acquire generalizable knowledge to help future people. But what sorts of (...) "use" are morally permissible? What is it to exploit people? Suppose that a trial conducted in a developing country would not be ethically permissible in the developed world. Can we automatically conclude from this that the trial is unethical, that some sort of morally problematic double standard is in operation? Allocation of very scarce medical interventions such as organs and vaccines is a persistent ethical challenge. We evaluate eight simple allocation principles that can be classified into four categories: treating people equally, favouring the worst-off, maximising total benefits, and promoting and rewarding social usefulness. No single principle is sufficient to incorporate all morally relevant considerations and therefore individual principles must be combined into multiprinciple allocation systems. We evaluate three systems: the United Network for Organ Sharing points systems, quality-adjusted life-years, and (...) disability-adjusted life-years. We recommend an alternative system—the complete lives system—which prioritises younger people who have not yet lived a complete life, and also incorporates prognosis, save the most lives, lottery, and instrumental value principles. Although for the last 50 years, ethicists dealing with human experimentation have focused primarily on the need to protect individual research subjects and vulnerable groups, biomedical research, especially in genetics, now requires the establishment of standards for the protection of communities. We have developed such a strategy, based on five steps. (i) Identification of community characteristics relevant to the biomedical research setting, (ii) delineation of a typology of different types of communities using these characteristics, (iii) determination of the range of (...) possible community protections, (iv) creation of connections between particular protections and one or more community characteristics necessary for its implementation, and (v) synthesis of community characteristics and possible protections to define protections appropriate for each type of community. According to the subjective view of lying, speakers can lie by asserting a true proposition, as long as they believe this proposition to be false. This view contrasts with the objective view, according to which lying requires the actual falsity of the proposition asserted. The aim of this paper is to draw attention to pairs of assertions that differ only in intuitively redundant content and to show that such pairs of assertions are a reason to favour the subjective view of (...) lying over the objective one. The COVID-19 pandemic has helped to clarify the fair and equitable allocation of scarce medical resources, both within and among countries. The ethical allocation of such resources entails a three-step process: (1) elucidating the fundamental ethical values for allocation, (2) using these values to delineate priority tiers for scarce resources, and (3) implementing the prioritisation to faithfully realise the fundamental values. Myriad reports and assessments have elucidated five core substantive values for ethical allocation: maximising benefits and minimising harms, mitigating unfair (...) disadvantage, equal moral concern, reciprocity, and instrumental value. These values are universal. None of the values are sufficient alone, and their relative weight and application will vary by context. In addition, there are procedural principles such as transparency, engagement, and evidence-responsiveness. Prioritising instrumental value and minimising harms during the COVID-19 pandemic led to widespread agreement on priority tiers to include health-care workers, first responders, people living in congregate housing, and people with an increased risk of death, such as older adults and individuals with medical conditions. However, the pandemic also revealed problems with the implementation of these values and priority tiers, such as allocation on the basis of population rather than COVID-19 burden, and passive allocation that exacerbated disparities by requiring recipients to spend time booking and travelling to appointments. This ethical framework should be the starting point for the allocation of scarce medical resources in future pandemics and other public health conditions. For instance, allocation of the new malaria vaccine among sub-Saharan African countries should be based not on reciprocity to countries that participated in research, but on maximally reducing serious illness and deaths, especially among infants and children. Many guidelines for international research require that studies be responsive to host community health needs or health priorities. Although responsiveness possesses great intuitive and rhetorical appeal, existing conceptions are confusing and difficult to apply. Not only are there few examples of what research the responsiveness requirement permits and what it rejects, but its application can lead to contradictory results. Because of the practical difficulties in applying responsiveness and the danger that misapplying responsiveness could harm the interests of developing countries, we (...) argue that responsiveness should be refocused in three ways: in terms of (1) who enforces it, (2) under what standard, and (3) in what cases. We conclude that responsiveness should be applied by host country officials at the policy level with the exercise of judgment when externally funded research threatens to displace scarce local resources. The standard Kratzerian analysis of modal auxiliaries, such as ‘may’ and ‘can’, takes them to be univocal and context-sensitive. Our first aim is to argue for an alternative view, on which such expressions are polysemous. Our second aim is to thereby shed light on the distinction between semantic context-sensitivity and polysemy. To achieve these aims, we examine the mechanisms of polysemy and context-sensitivity and provide criteria with which they can be held apart. We apply the criteria to modal auxiliaries and (...) show that the default hypothesis should be that they are polysemous, and not merely context-sensitive. We then respond to arguments against modal ambiguity. Finally, we show why modal polysemy has significant philosophical implications. (shrink)

El artículo analiza las ideas filosóficas de Lisandro de la Torre, dirigente político y destacado legislador argentino de vasta trayectoria pública entre 1890 y 1937, a partir de algunas conferencias y escritos de sus últimos años. En el enfoque de su cosmovisión se toman en cuenta, por un lado, la relación entre filosofía, ciencia y religión, y, por otro, la concepción antropológica, mostrando la influencia de perspectivas filosóficas como el panteísmo y el positivismo. El estudio somete a crítica la desvinculación (...) entre política y filosofía que hacía el propio de la Torre. Antes bien, concluye en que ambas esferas se encuentran conectadas y constituyen una raíz fundante del pensamiento latorrista.The article analyses Lisandro de la Torre's philosophical ideas. He was an important Argentinian politician, who had an active public life, mainly, as a legislator, between 1890 and 1937. The study is based upon some lectures and writings from his last years. His cosmological view is examined through the relation among philosophy, science and religion, on one hand, and through his anthropological account, on the other hand. The influence of pantheism and positivism is pointed out in both perspectives. It is criticised de la Torre's claim about politics as an anti-philosophical activity by arguing that philosophy and politics may be considered as foundations of his thought. (shrink)

La empatía ha sido foco de discusión en los círculos antipositivistas de la academia alemana de comienzos del siglo pasado, especialmente dentro del movimiento fenomenológico. El presente trabajo se concentra en el debate en torno a esta problemática que Alfred Schütz sostiene con Max Scheler en Der sinnhafte Aufbau der sozialen Welt. En el primer apartado se bosquejan los lineamientos principales de la teoría scheleriana de la Fremdwahrnehmung (percepción del otro), y en el segundo, se exponen las críticas que Schütz (...) le realiza a la misma sustentado en desarrollos teóricos de Edmund Husserl. La hipótesis que guía al escrito es que la confrontación con la teoría scheleriana de la Fremdwahrnehmung juega un rol fundamental en la configuración de la teoría del Fremdverstehen (comprensión del otro) del Schütz temprano. At the beginning of the 20th century the issue of empathy was subject of controversy within the phenomenological movement. The present paper deals with the debate on that topic that the young Alfred Schutz maintained with Max Scheler. Firstly, I outline the Schelerian theory of Fremdwahrnehmung (perception of the other), and secondly I present Schutz's criticism of the former, which is inspired by Husserl's insights on self-awareness and Einfühlung (empathy). My thesis is that in order to properly understand Schutz's theory of Fremdverstehen (understanding of the other) it is essential to take into account this early confrontation with Scheler. (shrink)

En el presente estudio procuraremos determinar los dos ejes de la ética unamuniana, que, al estar vinculados con el dualismo antropológico “yo-íntimo” y “yo-público”, podríamos condensar en los conceptos de “bondad” y “obra”. Unamuno, en cuanto heredero del romanticismo y del existencialismo, consideró que lo fundamental, en términos axiológicos, era que los individuos aprendiesen a “ser buenos” y no a “hacer [meramente] el bien”, ya que solo a través de la pureza del sentir, es decir, de la “bondad ética”, el (...) “sujeto moral” podría constituirse como una “persona” a través de sus “obras”. En este aspecto, la relación de la ética unamuniana con los “oficios” es decisiva, ya que cada “individuo” a través de su “profesión” está llamado a formar su “persona”. (shrink)

A core presumption of object oriented ontology and other speculative realisms is that there is a world independent of the mind that can be successfully inquired and should take center stage in our reflections again. A profound case for this realist presumption is found in Meillassoux’s After Finitude. He aims to secure our access to reality as it is in itself by refuting correlationism according to which we cannot escape reality as it is thought by us. He presents three arguments: (...) ancestrality, facticity and mathematization. On the first argument correlationism fails because it cannot render scientific statements about an universe anterior to us meaningful. I address the worry that he might not take this to be a real argument against correlationism and argue that it in any case fails. On the second argument correlationism is flawed since it remains committed to absolute possibilities. I argue that this argument is untenable as well. On his third argument correlationism fails because science reveals a mathematically describable reality indifferent to our existence. I argue that the almost perfect mathematization of nature can actually be cashed out as an argument for correlationism. I conclude by proposing an alternative way of showing that mathematics is the language of the absolute understood as a radical contingent hyperchaos. (shrink)

Drawing on evolutionary epistemology, process ontology, and a social-cognition approach, this book suggests cognitive evolution, an evolutionary-constructivist social and normative theory of change and stability of international social orders. It argues that practices and their background knowledge survive preferentially, communities of practice serve as their vehicle, and social orders evolve. As an evolutionary theory of world ordering, which does not borrow from the natural sciences, it explains why certain configurations of practices organize and govern social orders epistemically and normatively, and (...) why and how these configurations evolve from one social order to another. Suggesting a multiple and overlapping international social orders' approach, the book uses three running cases of contested orders - Europe's contemporary social order, the cyberspace order, and the corporate order - to illustrate the theory. Based on the concepts of common humanity and epistemological security, the author also submits a normative theory of better practices and of bounded progress. (shrink)

Traditionally, thinking about the whole led to logical contradictions. Taking as reference the Kantian antecedent, different contemporary philosophical notions of the universe are analysed in the first part of this paper, including realist and constructivist approaches, as well as a notion of the universe as a physical object. In the second part, the specific notion from the (...) standard physical cosmology is discussed. Although modelling the universe as a physical system provides a specific way to define some global properties, the universe as a whole remains empirically inaccessible. Hence, the discussion about the under-determined global properties depends ultimately on philosophical preferences. Under these circumstances, it is argued that the realist interpretation of such properties becomes problematic because it leads to unstable conclusions. Finally, it is argued that the notion of the universe as conceived in standard cosmology is not necessarily consistent with an approach that considers it to be a physical object. (shrink)

A new type of neuronal cell was discovered a few years ago: the mirror neurons. Their existence is a disturbing fact for our conceptions of intelligence and memory, giving to the whole universe of mind understanding a new logical framework. The impact of such a discovery on our concept of aesthetics and philosophy of thought makes us to recall Peirce, Lupasco, Buckminster Fuller launching ourselves to field folds, the super-string model or black holes among other non-linear time and space complexes.
